I was watching Politicking with Larry King on RT the other night and he had some Duffus on who was advocating the repealing of the 2nd Amendment because it was outdated since the founding fathers did not have semi automatic weapons. That there was no fear that the Government of the United Police States of America could turn dictatorial.
Well lets take it from the top, Title 10, section 311 of the US Code, defines "Militia" as two things, first is that it is the Regulated Militia's of the States which allows the States to stand against the Federal Standing Army if needed or to supplement the standing army during times of war or national emergency until the unregulated militia can be called forth. It also defines "Militia" as the Unregulated militia of the United States of America which is every male over the age of 17.
People have claimed that the 2nd Amendment is confusing because of the way it was written. "A well regulated militia being necessary to the security of a free state," "the right of the people to keep and bear arms shall not be infringed". Title 10, section 311 of the US Code clearly shows that the 2nd Amendment is a Dual purpose amendment.
A well regulated militia being necessary to the security of a free state, applies to the regulated militia's of the states. The right of the people to keep and bear arms shall not be infringed, applies to the unregulated militia of the United States of America.
Now the anti 2nd amendment advocates attempt to claim that the 2nd amendment only applies to the state militia's or as we call them National Guards. Title 10, section 311 of the US Code blows that claim out of the water but it is not the only thing that blows that claim out of the water.
During times of war or national emergencies the President of the United States of America can call forth the militia, we call this the national draft. While the last draft was during the Viet Nam war, we now operate an all volunteer military, but the draft can be reinstated at anytime by the President or Congress.
If the anti 2nd amendment folks were correct then the draft would only affect the National Guards, but it does not. The President of the United States of America can federalize the National Guards at anytime for any reason. Within hours of 9/11 National Guard Units were being federalized all over the Nation. No draft needed.
So who does the draft affect? The calling forth of the militia affects every male over the age of 17, the same people that make up the unregulated militia of the United States of America. The same people that the second part of the 2nd amendment relates to "The right of the people to keep and bear arms shall not be infringed".
Now this information invalidates the empty claims of the anti 2nd amendment folks. The unregulated militia of the United States of America have the constitutional right to keep and bear arms. So we can throw the anti 2nd amendment claims into the trash cans where they belong.
But we have one more issue to resolve, and that is what arms are protected by the 2nd amendment. The anti 2nd amendment crowed might grudgingly allow ball and powder match lock weapons, but not much else. But the Supreme Court of the United States of America has already ruled what weapons are protected under the 2nd amendment and which are not protected.
The 1939 Supreme Court Ruling in United States vs Miller established that weapons that could be found in the military armories or are suitable for the common defense of the nation are protected under the constitution. Weapons that do not lend themselves to military service or the common defense are not protected under the 2nd amendment.
So not only does every male over the age of 17 (with equal rights, women as well) have the constitutional right to keep and bear arms. But they are obligated to keep and bear arms that have inherent military value and can be used for the common defense of these United States.
Simple and straight forward, the 2nd amendment is a dual purpose amendment applying both to the regulated state militia's and the unregulated militia of the United States of America that is subject to the national draft. And a gentle reminder to the hunters and collectors out there that advocate the outlawing of military style or semi automatic weapons. Guess what according to that supreme court ruling the majority of your weapons are not protected by the 2nd amendment.
Now Mr. Kings guest Duffus also made the statement that there was no chance that the Government of the United States of America could possibly become the Government of the United Police States of America. I will assume that mr. Duffus is simply ignorant of modern events instead of simply being mentally challenged.
Mr. Snowden a true American Hero, showed proof that the Government of the United Police States of America has been knowingly violating the Constitution of the United States. That the Government is actively treating all American citizens as if they are known enemies of the state. The Government of the United Police States of America is training Airborne Special Forces and Black Operations Units for Heliborne assaults into American cities for the purpose of Urban Pacification.
The Government of the United Police States of America has granted Federal Law Enforcement Authority to the Pentagon and all Special Forces and Black Operation Units and the Navy and Army under the authority of the Pentagon. Homeland Security has been Issuing shooting targets showing armed American Citizens to desensitize the police, paramilitary police, special forces and black operations unit to the killing of American Citizens.
Homeland Security has or is purchasing 1.2 to 1.6 billion rounds of specialized ammunition such as hollow points, soft points and other ammunition that maximizes damage to the target. Target being (You). The Social Security Administration purchased over 250 million rounds of specialized ammunition.
NSA Dome camera's are being mounted to everything that is capable of holding their weight. Next time you go to your local store look for them. When you go for gas look for them. When driving down a street look at the light poles for little gray rectangle boxes with antennas coming out of the top of them and then turn off your smart phones, lap tops and tablets, because they are scanners.
And if at the intersections you see what looks like a small barrel sitting on top of a pole with a half oval top and bottom. You have just seen an EMP device and just hope it does not activate or all of your electronics and your car will be fried.
